Terms of Service
These Terms describe the rules and expectations for using our website and engaging our tax preparation services.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the RushTax Preparation website (rushtaxprep.com) and the tax preparation, planning, and related services offered by RushTax Preparation ("we," "us," "our," or "RushTax Preparation"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Description of Services
RushTax Preparation is a tax preparation firm providing federal and state tax return preparation, tax planning, and related services to individuals and businesses. Our services include:
- Preparation and filing of federal and state income tax returns
- Preparation of business entity returns (LLCs, S-Corps, C-Corps, partnerships)
- Self-employment and 1099 tax preparation
- Back-year return preparation for prior tax years
- Tax planning and advisory services
- IRS notice and audit support for returns we prepared
Complex IRS resolution matters (including Offers in Compromise, wage garnishment release, and tax attorney representation) are handled by our affiliated practice, RushTax Resolution, under a separate engagement.
3. Engagement Letter
For all tax preparation and advisory services, you will receive a written engagement letter describing the specific scope of services, the fees for those services, and the responsibilities of both parties. The engagement letter, once signed by both parties, governs the specific engagement together with these Terms. In the event of any conflict between the engagement letter and these Terms, the engagement letter controls.
4. Fees and Payment
Fees for our services are described in your engagement letter. Unless otherwise agreed in writing:
- Fees are due upon completion of services and prior to filing
- Payment may be made by credit card, ACH, or other approved methods
- Additional work outside the original scope will be quoted before it is performed
- Late payments may be subject to a service charge as permitted by law
- We reserve the right to withhold filing of returns until fees are paid in full
5. Your Responsibilities
You agree to:
- Provide complete, accurate, and timely information required for preparation of your return
- Maintain records supporting the information provided (income, deductions, credits)
- Review your prepared return carefully before signing and authorizing filing
- Sign required IRS forms (including Form 8879 for e-filing authorization) in a timely manner
- Pay any tax liability owed to the IRS or state tax authorities
- Notify us of any changes to your contact information, marital status, dependents, or other tax-relevant circumstances
You acknowledge that the accuracy of your return depends on the accuracy and completeness of information you provide. We rely on your representations and are not responsible for errors resulting from incomplete, inaccurate, or misleading information you supply.
6. Our Responsibilities
We commit to:
- Prepare your return with professional care and in accordance with applicable tax laws and standards
- Have every return reviewed by a licensed Enrolled Agent before filing
- Communicate clearly about the scope, timeline, and cost of our services
- Maintain the confidentiality of your tax information as required by law
- Stand behind our work, if we made a preparation error, we will correct it and, where applicable, cover any resulting penalties or interest attributable to our error
7. Refund Policy
Because tax preparation is a professional service, all fees are earned as work is performed. Fees paid for services already rendered are non-refundable. If you cancel an engagement before work has begun, you are entitled to a refund of any advance payment less any costs already incurred on your behalf.
8. Accuracy of Advice
Our services and any tax advice we provide are based on tax laws in effect at the time. Tax laws change frequently, and courts, the IRS, and state agencies regularly issue new interpretations. We are not responsible for changes in tax law occurring after we provide advice or after your return is filed, or for adverse outcomes resulting from such changes.
9. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to our services is limited to the fees you paid us for the specific engagement giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits our liability for professional negligence to the extent such limitation is prohibited by law or applicable professional standards.
10. Indemnification
You agree to indemnify and hold harmless RushTax Preparation, its affiliates, and its employees from any claims arising out of (a) information you provided that was inaccurate or incomplete, (b) your failure to comply with tax laws or these Terms, or (c) unauthorized use of our services or website.
11. Confidentiality
We maintain the confidentiality of your tax and financial information in accordance with our Privacy Policy, federal law (including 26 U.S.C. § 7216), and applicable professional standards. See our Privacy Policy for details.
